Appeal Practice

On July 24, 2009, we filed a "Friend of the Court" brief for our client TeleCommunication Systems, Inc. in the United States Supreme Court, weighing in on the issue of patent subject matter eligibility (08-964).

On October 6, 2008, we won a widely reported patent appeal for our client 1st Technology LLC against the online gambling enterprise Bodog Entertainment Group in the Court of Appeals for the Federal Circuit (App. No. 2008-1132) (affirming per curiam without opinion).

On December 26, 2007, we won a widely reported patent appeal for our clients HyperPhrase Technologies, LLC and HyperPhrase, Inc. against Google, Inc. in the Court of Appeals for the Federal Circuit (App. No. 2007-1125, -1176) (affirming-in-part and reversing-in-part).

Trial Court Actions

On June 23, 2009, we and our co-counsel won transfer from a California to a Maryland court, to bring a declaratory judgment case into our client’s home district.

On September 30, 2008, we and our co-counsel won a preliminary injunction against our client’s opponent, precluding the opponent from further fraudulent transfers of several intellectual property assets.

On January 7, 2008, we won dismissal on the pleadings of a complaint that accused our client of patent infringement.

Example Licensing Efforts

We are licensing counsel to a major intellectual property provider in the field of online promotions. Since 2003 we have favorably concluded dozens of license negotiations to bring significant revenue to our client.

In 2008 we counseled a food industry client through an important exclusive licensing transaction, allowing it to become the only company permitted to develop and sell an entirely new line of food product.
